- For the purposes of these Terms and Conditions:
a. “
Active” means that the Vitality Plan in question has no unpaid premiums, and has not been cancelled by the Eligible Participant or by Vitality;
b.
“Eligible Participant” means any individual who:
(i) is 18 years old or older;
(ii) holds an Active:
- VitalityHealth Plan (including the Business Healthcare, Corporate Healthcare and Personal Healthcare Plans);
2. VitalityLife Plan (including Personal Protection Plans and Business Protection Plans);
3. Vitality at Work Plan;
4. VitalityInvest Plan; and
(iii) has registered on the Member Zone; and
(iv) has declared that they are a current smoker in their Health Review;
c. “
Health Review” means the health review Vitality members participate in as part of the Vitality Scheme;
d. “
Member Zone” means the website found at
https://member.vitality.co.uk/;
e. “
Pelago” means Digital Therapeutics Ltd (trading as Pelago) (company no: 09851330 with registered address at Peer House, 8-14 Verulam Street, London, WC1X 8LZ;
f. “
Pelago Programme” means the 12-week smoking cessation programme provided by Pelago to Eligible Participants;
g.
“Vitality” means Vitality Corporate Services Limited and is registered in England and Wales with company number 05933141. The registered office address is 3 More London Riverside, London, SE1 2AQ, trading as VitalityHealth, VitalityInvest, VitalityLife;
h. “
Vitality Plan” means a Vitality at Work Plan, VitalityHealth Plan, VitalityLife Plan and/or a VitalityInvest Plan;
i. “
Vitality Points” means the points Vitality awards to Vitality members under the Vitality Scheme when they perform certain prescribed activities;
j.
“Vitality at Work Plan” means a programme administered by Vitality providing workplace health benefits to eligible businesses;
k.
“VitalityLife Plan” means a pure protection insurance contract, administered by Vitality trading as VitalityLife.
l.
“VitalityInvest Plan” means an ISA, JISA or pension product administered by Vitality trading as VitalityInvest.
m.
“VitalityHealth Plan” means a general insurance contract for the provision of private medical healthcare, administered by Vitality trading as VitalityHealth; and
n.
“Vitality Scheme” means the benefits programme administered by Vitality pursuant to which Vitality members are offered a range of wellness and lifestyle related benefits.
2. The Pelago Programme is open to all Eligible Participants who comply with these Terms and Conditions.
3. Eligible Participants who declare that they are a current smoker in their Health Review will be sent an email by Vitality providing them with a link to register to take part in the Pelago Programme. Eligible Participants will need to provide their name, email address, phone number, date of birth and their Vitality Plan membership number to Pelago in order to participate in the Pelago Programme.
4. Only one membership to the Pelago Programme is permitted per Eligible Participant.
5. Eligible Participants will have access to the Pelago Programme for 12 months, starting from the date they register with Pelago.
6. By registering to take part in the Pelago Programme, Eligible Participants consent to their name, e-mail, date of birth, phone number and Vitality Plan membership number (“
Personal Data”) being made available to Pelago, which will be used for the purposes of administering the Eligible Participant’s access to the Pelago Programme.
7. All Personal Data belonging to Eligible Participants will be held and used for the purposes of the Pelago Programme by Pelago in accordance with their privacy policy (which can be found on their website or if not, requested) and the Data Protection Act 2018.
8. Participation in the Pelago Programme will be subject to Pelago's own terms and conditions.
9. Eligible Participants who have signed up to the Pelago Programme before will not be able to sign up to the Pelago Programme again.
10. Eligible Participants will earn 1,200 Vitality Points when they engage with their ‘Quit Coach’ during the Pelago Programme. Eligible Participants will earn another 1,200 Vitality Points when they confirm they are smoke-free with their Quit Coach 3 months after completion of the Pelago Programme.
11. Vitality reserves the right to test all Eligible Participants’ smoking status upon completion of the Pelago Programme.
12. Vitality reserves the right to amend these Terms and Conditions on the provision of written notice or via Vitality’s website.
13. The Pelago Programme is non-transferable and non-exchangeable.
14. Vitality accepts no responsibility for information that is lost, stolen or unsuccessfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
15. These Terms and Conditions are governed by English law and the parties agree to submit to the exclusive jurisdiction of English and Welsh courts and tribunals with regard to any dispute or claim arising under these Terms and Conditions.
